These terms govern the use of the website pokemarketindex.org (the “Service”), operated by the provider named in the Legal Notice. By using the Service you agree to these terms.

The Service is a free informational offering. It calculates and publishes price indices and metrics for the collectible card market based on publicly available third-party market data. The Service is not a marketplace, does not broker purchases or sales and does not offer valuations of individual collections. There is no claim to constant availability or to a particular scope of features. The Service may be changed or discontinued at any time.

All content serves general information only. It does not constitute financial, investment or any other advice and is no invitation to buy or sell collectible cards or other items. Prices of collectibles fluctuate considerably and past developments do not predict future ones. Decisions you make on the basis of the data shown are made at your own risk.

The metrics shown are based on third-party market data (in particular publicly available price data of collectible card marketplaces) and on our own calculations following the approach described on the methodology page. Despite careful processing, data errors, transmission errors or delays can occur. No guarantee is given for the correctness, completeness or timeliness of the data.

The Service’s own content (texts, index calculations, presentations, design) is protected by copyright. Use for private, non-commercial purposes, including quotations with attribution, is permitted. Systematic or automated reproduction, extraction or redistribution of substantial parts of the Service requires the provider’s prior consent.

The Service is an independent project. It is not affiliated with, endorsed, sponsored or licensed by Nintendo, The Pokémon Company International or Creatures Inc. Pokémon and all related names are trademarks of their respective owners. Depicted card artwork and product photos remain the property of their respective rights holders and are shown solely to identify the collectibles discussed.

For damage arising from the use of this free Service, the provider is liable only in cases of intent and gross negligence and, without limitation, for injury to life, body or health and under mandatory statutory provisions. In particular, no liability is accepted for financial losses arising from decisions based on the data shown. The operators of external websites linked from the Service are responsible for their own content.

The law of the Federal Republic of Germany applies. The provider may amend these terms with effect for the future. The version published here applies. Should individual provisions be invalid, the validity of the remaining provisions remains unaffected.
